We act as an intermediary between you and travel suppliers, such as hotels, tour operators, airlines, and other service providers. The travel suppliers, not Pitomee, are responsible for providing the actual travel services.
To use our Services, you must be at least 18 years old and capable of forming a binding contract. By using our Services, you represent and warrant that you meet these requirements.
If you are using our Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and you agree to be bound by these Terms on behalf of that entity.
When you make a booking through Pitomee, you agree to review and follow all terms, conditions, and restrictions imposed by the travel suppliers. These may include, but are not limited to, payment requirements, age restrictions, insurance requirements, and health and safety protocols.
All bookings are subject to availability and confirmation. We reserve the right to refuse any booking at our discretion.
You are responsible for providing accurate and complete information when making a booking. This includes, but is not limited to, names as they appear on government-issued identification, birth dates, contact information, and any special requirements. Inaccurate or incomplete information may result in booking issues, cancellations, or additional fees.
Upon successful booking, you will receive a confirmation via email. Please review all details carefully and contact us immediately if there are any errors or discrepancies.
All prices are quoted in Canadian dollars (CAD) unless otherwise specified. Prices are subject to change until your booking is confirmed.
Payment terms vary depending on the type of service booked. Generally, the following applies:

Prices may not include all applicable taxes, fees, or charges imposed by government authorities or travel suppliers. You are responsible for paying all applicable taxes, fees, and charges, which will be disclosed to you before you complete your booking.
We accept various payment methods, including credit cards, debit cards, and electronic transfers. By providing your payment information, you authorize us to charge the applicable fees to that payment method.
Cancellation terms vary depending on the service booked and the travel supplier's policies. Specific cancellation terms will be provided at the time of booking. Generally:
If a travel supplier cancels a service, we will assist you in obtaining a refund or alternative arrangements according to the supplier's policies.
We are not liable for any cancellations, changes, or refunds resulting from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, strikes, natural disasters, pandemic, epidemic, or government-imposed travel restrictions.
We strongly recommend purchasing travel insurance to protect your investment in case of unexpected cancellations, interruptions, medical emergencies, or other unforeseen events.
You are responsible for obtaining and maintaining all necessary travel documentation, including but not limited to passports, visas, permits, and health certificates. We are not liable for any issues arising from inadequate or improper documentation.
You are responsible for meeting all health requirements for your destination(s), including vaccinations and medical clearances. We recommend consulting with your healthcare provider and reviewing government travel advisories before your trip.
We recommend checking for travel advisories issued by the Canadian government or your country of residence before traveling. We are not liable for any issues arising from traveling to areas with travel advisories.

Our Services and their contents, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the property of Pitomee, our travel suppliers, or our licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Services without our prior written consent.
Our Services may contain links to third-party websites, services, or content that are not owned or controlled by Pitomee. We do not endorse or assume any responsibility for any third-party websites, services, or content. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not guarantee that our Services will be uninterrupted, secure, or error-free, or that defects will be corrected.
We are not responsible for the accuracy, reliability, timeliness, or completeness of information provided by travel suppliers or other third parties.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PITOMEE, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE OUR SERVICES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO PITOMEE FOR THE SPECIFIC SERVICE GIVING RISE TO THE LIABILITY.
You agree to defend, indemnify, and hold harmless Pitomee, its affiliates, and their respective directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.
These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule.
Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the courts of the Province of Ontario, and you irrevocably submit to the jurisdiction of such courts.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice through our Services or by other means. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
